While Trump is travelling overseas, the Supreme Court has issued a ruling that essentially says “No, the President cannot deport under existing law members of a criminal syndicate that are in the United States illegally”. The act in question is the “Alien Enemies Act”. The members of these Venezuelan gangs are committing violent crime in the United States, thus are enemies under any sane definition, and are in this country illegally, therefore they are aliens. If this law doesn’t apply to them, it doesn’t apply to anyone. As usual Roberts and Amy Coney Barrett sided with the leftist members of the court but so did Kavanaugh and Gorsuch.
Makes one wonder if overturning Roe was worth filling the court with justices that are unreliable on any significant issues….
People are pissed about it. Matt Walsh writes: Ignore them and do it anyway….
Most of the replies seem supportive of Trump doing just that. Hell, invite the media to film live while these people are loaded onto military aircraft and sent to El Salvador. What is the court going to do about it?
Some are suggesting that this ruling is not really preventing the deportation of these people but the fact of the matter is that practically speaking it does just that. The court is issuing rulings based on trying to keep a lid on the boiling anger in this country, not on whether it actually is constitutional or not.
To put it another way, contra the SCOTUS ruling, the bureaucratic process should apply when people are trying to enter the country, not when people proven to be here illegally in the first place and members of a known violent gang are being removed. The burden should not be on the United States to explain why someone must go but on anyone desiring to come here as to why they should be allowed in.
We all know this, I am banging on about something that is understood to be true. The question is whether Trump has the spine to stand up to the Court, a co-equal part of the Federal government, not a superior branch to the executive, and do what has to be done whether they like it or not. It is high time for Trump to acquiant himself with a new term: Nonacquiescence
In law, nonacquiescence is the intentional failure by one branch of the government to comply with the decision of another to some degree. It tends to arise only in governments that feature a strong separation of powers, such as in the United States, and is much rarer in governments where such powers are partly or wholly fused. Nonacquiescence may lead to a constitutional crisis, given certain critical situations and decisions.
We could use a Constitutional crisis right about now. I don’t want this to be the way forward but I don’t want the court to prevent violent illegal aliens from being deported even more.
Each pathway that is closed off brings us closer to a binary option: either Trump capitulates and spends the next 3 1/2 years playing golf or he says “screw it” and does what has to be done.
Agreed...This decision will essentially prevent the President from doing anything about illegal immigrants once they get into our country...Many of us opposed Amy's nomination and this is just another example of why...Women always sympathize with criminals, because they are perceived as strong bad boys...This is just another example...Women should not be on the Court...
Time to go all Andrew Jackson on this ruling.
